Legal updates
This page outlines proposed or recent changes to the law which may impact on your not-for-profit community organisation.
Victorian incorporated associations
Not-for-profit organisations that are incorporated as associations in Victoria are required to comply with the Associations Incorporation Act 1981 (Vic). In 2009 and 2010 the Victorian Government has been revising this legislation. This will mean that associations will have to review their operations to make sure they are complying with the revised law. This may include changes to the kind of financial reporting associations will need to provide Consumer Affairs Victoria, and also changes to an association's rules.
A summary of the key changes is available below.
The changes are being implemented as a two stage process. One series of amendments was passed by Parliament in 2009 (some of these changes are to come in to effect in 2011). The second phase of changes have been passed by Parliament and is set to come into force on 1 July 2024 (note: this has changed from 1 December 2024). See the links below for further details.

Companies limited by guarantee
Not-for-profit organisations that are incorporated as companies limited by guarantee are regulated by the Corporations Act 2001 (Cth). In June 2010 the Federal Government has made changes to the Corporations Act and these changes will impact on the legal obligations of companies limited by guarantee (particularly their financial reporting obligations).
