Draft Model Rules Released for Public Consultation
Consumer Affairs Victoria has released proposed Associations Incorporation Reform Regulations and a regulatory impact statement (RIS) for public consultation. The proposed Regulations include new Model Rules for Victorian incorporated associations that reflect upcoming changes in the law.
As readers of this e-bulletin will be aware, in April this year, the Associations Incorporation Reform Act 2012 was passed by the Victorian Parliament. The new Act introduces changes to the framework for Incorporated Associations and consolidates previous amendments passed in 2009 and 2010.
The Act has a delayed implementation, meaning the changes are not yet applicable and the implementation date has not yet been confirmed. It was expected that the new Act would commence operation on 1 December 2012, but based on today's release of the proposed Regulations, we understand the Act could be brought into force earlier.
The proposed Model Rules contained in Schedule 4 of the Regulations form an important part of the new framework for incorporated associations, and we know that many Victorian not-for-profit organisations have been eagerly awaiting their release.
We encourage Victorian organisations to participate in the consultation process before the final version of the Model Rules is settled.
