We commend the Australian Government on its initiative to undertake the Consultation. [Summarise your key points] Recommendations [Name of Organisation] submits that the National Human Rights Consultation Committee (Committee) should recommend: [Recommendation 1]; [Recommendation 2]; Part B About this submission About [Organisation] [Insert paragraph about your organisation, its objectives, its clients, the types of services it provides, the expertise that it possesses] Eg. 1 - PILCH is an independent, not-for-profit organisation that is committed to furthering the public interest, improving access to justice and protecting human rights. PILCH does this by facilitating the provision of pro bono legal services, and by undertaking law reform, policy work and legal education. In carrying out its mission, PILCH specifically seeks to: address disadvantage and marginalisation in the community; effect structural change to address injustice; foster a strong pro bono culture; and, increase the pro bono capacity of the legal profession Eg. 2 Brimworth Secondary College is a state co-educational secondary school located in inner Melbourne. It provides teaching to over 500 students from year 7 to year 11. The College is non-selective and draws students from over 20 primary schools in the Cities of Yarra, Melbourne, Moreland and Darebin. The College has the following aims: Scope of the submission [Insert a paragraph explaining the context of the submission] Eg. This submission is made in response to the three key questions raised in the Attorney-Generals National Human Rights Consultation: Background Paper (Background Paper), namely: Which human rights (including corresponding responsibilities) should be protected and promoted? Are these human rights currently sufficiently protected and promoted? How could Australia better protect and promote human rights? If relevant, you may wish to explain here: that you have limited your submission to focus on areas of particular relevance to your organisation; That in some areas you have chosen to endorse the submission of another organisation; and/or That you have chosen to take a particular approach e.g. you will be focussing on cases studies and the practical need for better human rights protection rather than legal or academic arguments Eg. Because this organisation provides services primary to Indigenous Victorians, this submission will focus on the human rights that particularly affect the Indigenous population and the ways in which these human rights could be better protected and promoted. Where the organisation feels that it would be beneficial to do so, we have endorsed the submissions of [Insert name of other organisations]. We have chosen to adopt a case study based approach to illustrate the need for greater human rights protection. Structure of the submission [Insert paragraph outlining how you intend to structure the submission] Eg. This submission will examine in turn each of the three questions asked by the National Human Rights Consultation Committee (Committee). The submission will begin by examining which human rights should be protected and promoted in Australia. While stressing the importance of protecting all human rights, the submission will focus on a number of rights that are of particular importance to [insert organisations] clients. The importance of these rights will be discussed in detail. The submission will then examine whether human rights are currently sufficiently protected and promoted in Australia. In our organisations experience there are a number of significant gaps in the protection currently afforded to human rights. The submission will use examples and case studies to highlight the deficiencies in the current system of rights protection. Finally the submission will examine how Australia could better protect human rights. This part of the submission will look at the arguments for and against the introduction of a Human Rights Act as well as other mechanisms of human rights protection that will be necessary to ensure the effectiveness of such a Human Rights Act. Part C Question 1: Which human rights should be protected and promoted? Introduction Which Rights should be protected and promoted? Identify the human rights that you believe should be protected and promoted and explain why your organisation believes they are important. You may wish to have a subheading for each right and discuss the rights that are most important in some detail. You might want to consider whose rights should be protected, and who should be held accountable for protecting those rights. It would be particularly helpful if you can include examples, case studies or research findings from your work to support your submission. Eg. This organisation submits that Australia has an obligation to protect each of the human rights contained in international treaties which Australia has signed. Of particular importance to our clients, who are persons experiencing homelessness are economic, social and cultural rights. While these rights remain unfulfilled civil and political rights such as the right to a fair trial and the right to public participation in the affairs of government are meaningless. For our clients, the most important rights are: the right to non-discrimination, the right to health, the right to social security and the right to privacy. Rights that you may wish to discuss include: Right to self-determination Right to equality and freedom from discrimination Right to an adequate standard of living Right to the highest possible standard of health Freedom from torture or cruel, inhuman or degrading treatment Freedom of movement Right to privacy Freedom of association and peaceful assembly Freedom of speech and expression Freedom from forced work Right to liberty, safety and security of the person Right to maintain culture and language Freedom from being tried and punished more than once Right not to be arbitrarily detained or imprisoned Childrens rightsRight to be treated with dignity and respect Right to life Right to adequate housing Right to participate in public life Right to live with your family Right to a fair trial Freedom of thought, conscience, religion and belief Right to vote Right to work Right join and form trade unions Right to an adequate income and social security Right to adequate food and water Freedom from discrimination on the grounds of gender or sex Right to humane treatment when deprived of liberty Right to marriage Right to education Womens rights Recommendation No. [*] Note: You may choose to include a number of recommendations at the end of each part of the submission. Alternatively you may consider it more appropriate to break them up through out the submission so that they are included where they are being discussed. Part D Question 2: Are human rights currently sufficiently protected and promoted? Introduction The current system for protecting and promoting human rights Insert details of how the human rights of the clients of your organisation are currently protected. This may include information about legislation, departmental policies, common law. Eg. Currently the human rights of our members, working mothers, are protected by the common law, as well as a number of equal opportunity statutes at both the federal and state level. These protections aim to ensure that women are not discriminated against in the following ways ... Failure of current system to adequately protect and promote human rights This is the place where you should identify the gaps in current protections of human rights. You should give examples of times where the human rights of your organisations clients have been violated or inadequately protected. You should provide a description of the situation and explain how the violation of rights affected the person involved. Eg. Many of our clients report difficulties in accessing affordable and timely health care. One client reported going to the local emergency department of her hospital with severe stomach pains. She waited two hours before being turned away and told to see the local doctor. Her doctor doesnt bulk-bill anymore. On the day she was sick, she didnt have the money to pay $35 to see the doctor, even though she will get $25 back from Medicare later. She waited two days for her Centrelink payment before going to the doctor. Recommendation No. [*] Part E Question 3: How could Australia better protect and promote human rights? Introduction A Human Rights Act This is where you should explain whether or not you consider that a human rights Act is a good idea. Use of examples will enhance your argument. You may decide to use examples from other jurisdictions such as ACT, Victoria or others, where human rights legislation has led to better outcomes for clients similar to your own. You may also want to give example of situations where an unsatisfactory outcome was reached but where stronger human rights protection may have achieved a fairer outcome. You could recognise arguments that do not support your position and identify the flaws in those arguments. Issues to consider include: Arguments for a Bill of RightsArguments Against a Bill of Rights Promote human dignity and respectCreate a flood of litigationImpose responsibilities on government with respect to human rightsFavour terrorists, criminals and accused personsProtect my human rights.Encourage judicial activismMake government accountable for rights violationsWeaken Parliaments capacity to legislate on human rightsCreate a rights-respecting cultureInadvertently limit human rightsEducate people about human rights and dignityThreaten religious freedomsDeter human rights violations through sanctions Be unnecessary, as the current system for the protection and promotion of human rights in Australia is adequateProtect the rights of the marginalised and disadvantagedEmpower people to be involved in decisions that affect themBring Australia in line with other democratic nationsInstil a set of national values and result in greater national unity Recommendation No. [*] Key elements of a Human Rights Act (if you consider that one should be enacted) This section is where you should outline what you think a human rights Act should look like. This may include discussion of: Which human rights should be protected by a Human Rights Act? (eg. All rights covered by treaties Australia has signed; only civil and political rights; economic, social and cultural rights; rights of persons with a disability; womens rights; rights of indigenous Australians; etc) Who should be obliged to protect rights and how? (eg. parliament, the executive, public authorities, the courts, others) What sort remedies should be included in a Human Rights Act? (eg. damages, injunctions, declarations of inconsistency of a law) What sort of limits should a government be able to place on human rights? What should be included in a preamble to any Human Rights Act? (eg. important guiding principles, such as the importance of living a life of dignity or recognition of indigenous Australians) Recommendation No. [*] Other measures necessary to ensure an effective Human Rights Act This is where you should outline any additional measures that the government should consider for better protection of human rights. For example: Public education campaigns on human rights Human rights training for government agencies and public Improved monitoring and reporting requirements Increased funding for Legal Aid, Community Legal Services, Advocates Increased funding for services providing health and housing services Other suggestions. You may also wish to encourage government to ratify a particular international treaty which provides for the rights of your clients. For example the optional protocol to the Convention on Economic, Social and Cultural rights.
